1. Provider and scope
These terms and conditions apply to all services provided by the systemic consulting practice of Bernd Nickel and Doris Nickel, Am Talhaus 10, 67316 Carlsberg.
They apply to all contracts for couple and relationship counseling, individual counseling and coaching, regardless of whether these are provided in person or online.
Any differing agreements must be in writing.
2. Type of service and legal classification
The services offered are private, non-medical consulting services. They are intended exclusively for mentally healthy, self-reliant adults.
The consultation serves to reflect on, clarify and further develop relationships, communication, behavior and personal decision-making options.
Billing through health insurance companies or public funding bodies is not possible.
3. No medical treatment and no welfare services
The services offered do not constitute medical treatment. No diagnoses are made, no illnesses are treated, and no promises of healing or improvement are given. There is deliberately no legal license to practice medicine.
Should there be any indications of mental illnesses requiring treatment, a referral will be made to licensed psychotherapists or medical practitioners.
These are not welfare services. No systematic assistance is provided to vulnerable or especially vulnerable groups.
4. Ordering procedure and appointment scheduling
The consulting practice is considered Ordering practice Conducted. Appointments are binding and reserved exclusively for the respective client.
Individual and couples counseling as well as coaching are usually booked digitally. Intensive formats are agreed upon in writing.
5. Appointment cancellations in the appointment-based practice
By scheduling an appointment, the client expressly acknowledges that the time allocated for the appointment is reserved exclusively and cannot usually be reassigned at short notice.
A free cancellation is possible until the latest 48h Cancellations are possible before the scheduled appointment. For Monday appointments, free cancellation is possible until Friday at 1 p.m.
In case of late cancellation or no-show, the full fee is due. Proof of a specific loss of earnings is not required.
Statutory rights of withdrawal for distance contracts remain unaffected.
Right of withdrawal for distance contracts
Consumers have a statutory right of withdrawal for distance contracts in accordance with § 312g of the German Civil Code (BGB). 14 days.
The right of withdrawal expires prematurely for services in accordance with § 356 para. 4 of the German Civil Code (BGB) if the provider has fully performed the service and the client has expressly agreed beforehand that the service will begin before the end of the withdrawal period, and has simultaneously confirmed that they will lose the right of withdrawal upon complete fulfillment of the contract.
If the client has requested that the service should begin during the cancellation period, then in the event of a cancellation, a reasonable amount must be paid which corresponds to the proportion of the services provided up to the point of cancellation.
6. Quota and package services
Quotas and packages are fixed-book service packages that serve planning security for both contracting parties and are priced at a reduced rate compared to individual bookings.
Unless expressly agreed otherwise, quotas must be met within 12 Monaten Can be used from the booking date.
Refunds for unused hours within a quota or package are excluded.
7. Subject matter of the contract and personal responsibility
The subject of the contract is the provision of the agreed consulting services. not available the achievement of a specific success.
Decisions and changes are solely the responsibility of the clients.
The consultation is based on information provided by the clients. They themselves are responsible for the accuracy and completeness of this information.
8. Initial and clarification meeting
The initial consultation serves to clarify the issue and to determine whether counselling in this context is appropriate. It constitutes a comprehensive counselling service.
For online video meetings, the invoice amount for the initial consultation and clarification meeting is due before the appointment; for in-person consultations, it is due immediately after the session.

9. Fees and invoicing
After the initial consultation and clarification meeting, you are free to decide whether you want to continue with individual lessons or book a package of sessions.

The consultation is a service. No specific outcome is guaranteed.
Liability for damages resulting from injury to life, body or health remains unaffected.
The provider is only liable for other damages in cases of intent or gross negligence.
The use of electronic communication tools is at the clients' own risk.
11. Contractual confidentiality
The provider undertakes to maintain strict confidentiality regarding all personal and private information disclosed during the consultation. This contractual confidentiality obligation applies indefinitely, even after the termination of the contractual relationship.
12. Clients' duty to cooperate
The consultation is based on cooperation, openness, and personal responsibility.
The willingness to actively participate is a prerequisite for using the service.
13. Insurance and liability for one's own actions
Clients bear full responsibility for themselves and their actions both within and outside of counseling sessions.
There is no insurance coverage through the provider.

15. Changes to the Terms and Conditions
The provider reserves the right to amend these terms and conditions for legitimate reasons. The version valid at the time of order placement shall apply.
16. Applicable Law and Jurisdiction
The laws of the Federal Republic of Germany apply. The place of performance and jurisdiction is 67316 Carlsberg, to the extent permitted by law.
17. Dispute Settlement
The provider is neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
